§ 14-1. Definitions.

  • As used in this chapter, the following terms shall have the respective meanings ascribed to them:

    Alcoholic beverage: Alcohol and any beverage containing more than one-half of one percent of alcohol by volume which is capable of use for beverage purposes, either alone or when diluted.

    Athletic complex. Any field and structure located thereon in the city which is designated as an athletic complex by the community services director, which complex shall include any fields, stands, bleachers, dugouts, sideline areas, shelters, concession stands or other enclosures, or any area which may actually have athletic play conducted thereon, such athletic play including but not limited to football, soccer, baseball, and softball.

    Community services director or director: A person so designated and in charge of the park and recreation department or any subdivision thereof, including those in charge of any park area and its activities.

    Loiter: The walking around aimlessly without apparent purpose; lingering; hanging around; lagging behind; the idle spending of time; delaying; sauntering and moving about where such conduct is not due to physical defects or conditions.

    Park: Any city owned or operated real property and any improvements located thereon as a park, reservation, playground, recreation center, trail systems and land appurtenance thereto, or any area in the city owned property or property used by the city, and devoted to active or passive recreation, including all planted medians, parkways, triangles and traffic circles maintained by the city.

    Personal mobility device: A device motorized or powered by human power to provide assistance to a person with an ambulatory disability, as defined under V.T.C.A., Transporation Code § 681.001 (2).

    Special event shall mean an event to be held within the town, that is of limited duration and is likely to attract visitors. Examples of special events include (without limitation) exhibition, automobile races, sporting events, festivals, air shows and parades.

    Shoreline trail shall mean that portion of the city trail system that is contained within the Army Corp of Engineer Property adjacent to and contiguous to Lake Lewisville.

    Trail: A publicly owned or maintained trail/path system, including trailheads as defined in the parks and recreational master plan for use by pedestrians and cyclists using non-motorized bicycles

    Vehicle: A device that can be used to transport or draw persons or property on a highway, roadway or public road. The term does not include:

    (1)

    A device exclusively used on stationary rails or tracks;

    (2)

    Manufactured housing as that term is defined by V.T.C.A., Occupations Code ch. 1201.

    (3)

    A baby carriage; or

    (4)

    A person with a disability mobility device.

    (5)

    A vehicle in the service of the city or a public utility.
