§ 19-21. Bicycles, electric bicycles and mopeds—Definitions.

  • For purposes of this chapter, the following terms shall have the meaning ascribed to them:

    Bicycle: means a device that a person may ride and that is propelled by human power and has two tandem wheels at least one of which is more than 14 inches in diameter. The provisions in this chapter on bicycles shall also be applicable to electric bicycles and mopeds, except for any provision that, by its nature, cannot be applicable thereto.

    Business districts: means the territory adjacent to and including a highway if buildings used for business or industrial purposes, including a building used as a hotel, bank, office building, public building, or railroad station:

    (1)

    Are located within a 600-foot segment along the highway; and

    (2)

    Within that segment the buildings occupy at least 300 feet of frontage:

    a.

    On one side of the highway; or

    b.

    Collectively on both sides of the highway.

    Electric bicycle means a bicycle that:

    (1)

    Is designed to be propelled by an electric motor, exclusively or in combination with the application of human power;

    (2)

    Cannot attain a speed of more than 20 miles per hour without the application of human power; and

    (3)

    Does not exceed a weight of 100 pounds.

    Moped means a motor-driven cycle that cannot attain a speed in one mile of more than 30 miles per hour and the engine of which:

    (1)

    Cannot produce more than two-brake horsepower; and

    (2)

    if an internal combustion engine, has a piston displacement of 50 cubic centimeters or less and connects to a power drive system that does not require the operator to shift gears.
