§ 1-9. Ordinances not affected by adoption of Code.

  • The repeal provided for in the ordinance adopting this Code shall not affect any of the following, and the same shall continue in force and effect to the same extent as if this Code had not been adopted:

    (1)

    Any ordinance promising or guaranteeing the payment of money by the city, or authorizing the issuance of any bonds of the city or any evidence of the city's indebtedness, or authorizing the execution of a contract by a representative of the city;

    (2)

    Any ordinance dedicating, naming, establishing, locating, relocating, opening, paving, widening, abandoning, vacating, etc., any street or public way in the city;

    (3)

    Any ordinance relating to municipal street maintenance agreements with the state;

    (4)

    Any ordinance establishing or prescribing grades for streets in the city;

    (5)

    Any appropriation ordinance or ordinance providing for the levy of taxes or for an annual budget; or prescribing salaries for city officers and employees; or prescribing permit or inspection fees not in conflict herewith;

    (6)

    Any ordinance relating to local improvements and assessments therefor;

    (7)

    Any ordinance annexing territory to the city or disannexing territory as a part of the city, or defining the limits of the city;

    (8)

    Any zoning or subdivision ordinance or regulation, or any ordinance amending the zoning map or zoning or rezoning specific property, or any ordinance accepting any plat or subdivision;

    (9)

    Any ordinance granting any franchise or easement, or any ordinance terminating any franchise or easement; or any ordinance purporting to be an agreement between the city and a utility company;

    (10)

    Any special or temporary ordinance.
