§ 6-6. Appeals; variances.

  • (a)

    The zoning board of adjustment shall hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by the building official or any inspector in the enforcement of any of the codes adopted in this chapter.

    (b)

    The zoning board of adjustment may authorize upon appeal in specific cases such variance from the terms of the codes adopted in this chapter, only in those codes wherein variances are authorized, as will not be contrary to the public interest, where, owning to special conditions, a literal enforcement of the provisions of a code will result in unnecessary hardship, and so that the spirit of the code shall be observed and substantial justice done.

    (c)

    The zoning board of adjustment shall be construed to be the appeals board in lieu of any such board referred to in any of the codes adopted herein.
